CIDH CONDENA ASESINATO DE DEFENSOR DE DERECHOS HUMANOS EN MÉXICO

Washington, D.C., 25 de abril de 2011 - La Comisión Interamericana de Derechos Humanos (CIDH) condena el asesinato en México del defensor de derechos humanos Javier Torres Cruz, integrante e la Organización de Campesinos Ecologistas de la Sierra de Petatlán y Coyuca de Catalán. La CIDH insta al Estado mexicano a investigar este crimen, esclarecerlo judicialmente y sancionar a los responsables materiales e intelectuales.

Según la información recibida por la CIDH, el 18 de abril de 2011 Javier Torres Cruz fue asesinado por hombres armados cerca de su comunidad, La Morena, en el municipio de Petatlán, estado de Guerrero, México, presuntamente en relación con sus actividades de defensa del derecho al medio ambiente sano en la sierra de Petatlán. La información recibida también indica que su hermano Felipe Torres, quien lo acompañaba al momento de los hechos, resultó gravemente herido.

La Comisión Interamericana ha recibido información sobre presuntas amenazas, actos de hostigamiento y atentados sufridos por Javier Torres Cruz y varios de sus familiares desde 2007. La información recibida indica que el 3 de diciembre de 2008, Torres Cruz habría sido detenido ilegalmente por soldados del Ejército mexicano, y que éstos presuntamente lo entregaron a otras personas que lo habrían sometido a torturas durante varios días. Esta situación fue denunciada por Javier Torres Cruz ante la Comisión Estatal de Defensa de los Derechos Humanos de Guerrero y ante el Ministerio Público.

La CIDH recuerda que es obligación del Estado investigar de oficio hechos de esta naturaleza y sancionar a los responsables. Asimismo, la Comisión insta al Estado de México a adoptar en forma inmediata y urgente todas las medidas necesarias a fin de garantizar el derecho a la vida, la integridad y la seguridad de los familiares de Javier Torres Cruz, y para la debida protección de las defensoras y defensores de derechos humanos en el país.

Como ha señalado la Comisión anteriormente, los actos de violencia y otros ataques contra las defensoras y los defensores de derechos humanos no solo afectan las garantías propias de todo ser humano sino que atentan contra el papel fundamental que juegan en la sociedad y sume en la indefensión a todas aquellas personas para quienes trabajan. La Comisión recuerda asimismo que la labor de defensores y defensoras es esencial para la construcción de una sociedad democrática sólida y duradera, y tienen un papel protagónico en el proceso para el logro pleno del Estado de Derecho y el fortalecimiento de la democracia.

La CIDH es un órgano principal y autónomo de la Organización de los Estados Americanos (OEA), cuyo mandato surge de la Carta de la OEA y de la Convención Americana sobre Derechos Humanos. La Comisión Interamericana tiene el mandato de promover la observancia de los derechos humanos en la región y actúa como órgano consultivo de la OEA en la materia. La CIDH está integrada por siete miembros independientes que son elegidos por la Asamblea General de la OEA a título personal, y no representan sus países de origen o residencia.

IACHR CONDEMNS MURDER OF HUMAN RIGHTS DEFENDER IN MEXICO

Washington, D.C., April 25, 2011—The Inter-American Commission on Human Rights (IACHR) condemns the murder in Mexico of human rights defender Javier Torres Cruz, a member of the Organization of Campesino Ecologists of the Sierra de Petatlán and Coyuca de Catalán. The IACHR urges the Mexican State to investigate and legally clarify this crime, and punish the perpetrators and masterminds.

According to the information received by the IACHR, on April 18, 2011, Javier Torres Cruz was killed by armed men near his community of La Morena—located in the municipality of Petatlán, in the Mexican state of Guerrero—allegedly because of his activities to defend the right to a healthy environment in the Sierra de Petatlán. The information received also indicates that his brother Felipe Torres, who was with him at the time the events occurred, was seriously injured.

The Inter-American Commission has received information about alleged threats, acts of harassment, and attacks suffered by Javier Torres Cruz and several of his family members since 2007. The information receive alleges that on December 3, 2008, Torres Cruz was detained illegally by soldiers of the Mexican Army, and that these soldiers reportedly turned him over to other individuals who subjected him to torture for several days. Javier Torres Cruz reported this situation to the Guerrero State Commission for the Defense of Human Rights and to the Office of the Public Prosecutor.

The IACHR calls to mind that it is the State’s obligation to investigate such acts of its own accord and to punish those responsible. The Commission also urges the State of Mexico to immediately and urgently adopt all necessary measures to guarantee the right to life, integrity, and security of the relatives of Javier Torres Cruz, and to ensure due protection for human rights defenders in the country.

As the Commission has noted previously, acts of violence and other attacks perpetrated against human rights defenders not only affect the guarantees that belong to all human beings; they also undermine the fundamental role human rights defenders play in society and contribute to the vulnerability of all those whose rights they champion. The Commission also recalls that the work of human rights defenders is critical for building a solid and lasting democratic society. Human rights defenders play a leading role in the process of seeking to attain the full rule of law and the strengthening of democracy.

A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has a mandate to promote respect for human rights in the region and acts as a consultative body to the OAS in this matter. The Commission is composed of seven independent members who are elected in a personal capacity by the OAS General Assembly and who do not represent their countries of origin or residence.
